While some states enforce a “first bite” law, Michigan holds the owner of the animal responsible for any attacks on behalf of the animal. There are only two instances in which an owner can avoid responsibility for his animal:

  1. if the victim of the attack was trespassing on the dog owner’s property
  2. if the victim of the attack “provoked” the animal

The term “provoked” has been interpreted very loosely in past dog bite cases. In one instance, a child’s attempt to hug the animal was deemed provocative and the case was dropped.
